Closing eyes on collective expulsions at the border: is the ECtHR still a guarantor of foreigners’ fundamental rights?

European Court of Human Rights, Judgment of 5 April 2022, A.A. and Others v. North Macedonia, App. nos. 55798/16 et al.

Following the judgment N.D. and N.T. v. Spain, the ECtHR has issued another judgment concerning the scope of application of Article 4 Prot. 4 ECHR. While the Court acknowledged the respondent State’s jurisdiction, it nonetheless denied that a violation of the absolute prohibition of collective expulsion had occurred, building up its findings on the ‘culpable conduct’ test.

She is a PhD candidate at the University of Luxembourg faculty of law economics and finance, and at the University of Bologna school of law (cotutelle de thèse). She is mainly interested in issues related to the effectiveness of EU law, the development of EU operational action and the interference of legal orders.
She graduated in Law from the University of Trento, Italy. During her studies she studied in China, obtaining an overseas scholarship at Shanghai International Studies University and in the Netherlands where she spent a semester as visiting researcher at the Maastricht University. She also holds an LLM in European Law from University Paris II Panthéon Assas and since 2020 she is qualified to practice as a lawyer in Italy.

È Cultore della materia di Diritto processuale penale presso la medesima università, dove si è laureato nel dicembre 2017.
